RESIDENTIAL LEASE AGREEMENT This Residential Lease Agreement (this "Agreement" or "Lease") is entered into as of 2026-06-16, between: LANDLORD: [LANDLORD NAME] California TENANT(S): [TENANT NAME(S)] PROPERTY: California Property Type: Residential | Unfurnished ARTICLE 1: LEASE TERM This Lease shall commence on 2026-06-16 and shall expire on 2027-06-16 ("Lease Term"), unless sooner terminated in accordance with this Agreement. ARTICLE 2: RENT 2.1 Monthly Rent. Tenant agrees to pay Landlord the sum of $______ per month as rent for the Property ("Monthly Rent"). 2.2 Due Date. Rent is due on the 1st day of each calendar month. 2.3 Payment Method. Rent shall be paid by check, money order, or electronic transfer. 2.4 Late Fee. If rent is not received within 5 days of the due date, a late fee of $______ shall be assessed. This fee is in addition to the rent due and does not constitute permission to pay rent late. ARTICLE 3: SECURITY DEPOSIT 3.1 Amount. Upon execution of this Lease, Tenant shall deposit with Landlord the sum of $______ as a security deposit ("Security Deposit"). 3.2 Purpose. The Security Deposit shall be held as security for Tenant's faithful performance of all obligations under this Lease. Tenant may not apply the Security Deposit as rent. 3.3 Return. The Security Deposit, less lawful deductions, shall be returned to Tenant within the period required by applicable state law after Tenant vacates, along with an itemized statement of deductions. 3.4 Deductions. Landlord may deduct for: (a) unpaid rent or other charges; (b) damage beyond normal wear and tear; (c) cleaning costs; and (d) other amounts permitted by law. ARTICLE 4: UTILITIES AND SERVICES 4.1 Landlord-Provided Utilities. The following utilities are included in the Monthly Rent: None — Tenant is responsible for all utilities. 4.2 Tenant-Provided Utilities. Tenant is responsible for establishing and paying all costs for utilities not listed above, including any connection or activation fees. ARTICLE 5: USE OF PROPERTY 5.1 Residential Use. Tenant shall use the Property solely for residential purposes and as a private dwelling. No commercial activity is permitted without Landlord's prior written consent. 5.2 Pets. No pets are permitted on the Property without the prior written consent of Landlord. 5.3 Smoking. Smoking of any substance — including cigarettes, cigars, pipes, vaping devices, and marijuana — is strictly prohibited inside the Property and within 25 feet of any entrance. 5.4 Guests. Guests may not stay at the Property for more than 14 consecutive days or 30 total days in any 12-month period without Landlord's prior written approval. Unauthorized occupants constitute a material breach of this Lease. 5.5 Subletting. Tenant shall not sublet all or any portion of the Property, nor assign this Lease, without Landlord's prior written consent, which may be withheld in Landlord's sole discretion. ARTICLE 6: MAINTENANCE AND REPAIRS 6.1 Landlord Obligations. Landlord shall maintain the Property in habitable condition, including structural components, plumbing, electrical systems, heating/cooling systems, and common areas in good working order as required by applicable law. 6.2 Tenant Obligations. Tenant shall: (a) keep the Property in clean and sanitary condition; (b) properly dispose of all garbage and recyclables; (c) promptly report any damage or maintenance issues to Landlord in writing; (d) not intentionally or negligently damage the Property or fixtures; and (e) handle minor maintenance costing less than $100 such as replacing light bulbs, batteries in smoke detectors, and minor caulking. 6.3 Tenant Damage. Tenant shall be liable for all damage to the Property caused by Tenant, Tenant's guests, occupants, or pets, beyond normal wear and tear. ARTICLE 8: ENTRY BY LANDLORD Landlord or Landlord's agents may enter the Property at reasonable times upon 24-hour advance written notice for: inspections, repairs, improvements, showing the Property to prospective tenants or buyers, or other lawful purposes. In case of emergency, Landlord may enter without notice to prevent injury or property damage. ARTICLE 9: EARLY TERMINATION 9.1 No Early Termination Right. This Lease does not provide a right of early termination. Tenant remains responsible for rent through the end of the Lease Term unless Landlord agrees in writing to release Tenant from this obligation. ARTICLE 10: RENEWAL AND HOLDOVER Unless either party provides written notice of non-renewal at least 30 days before expiration, this Lease shall convert to a month-to-month tenancy upon the same terms and conditions. Either party may then terminate with 30 days written notice. If Tenant remains in possession after the Lease Term without a written renewal agreement, Tenant shall be a holdover tenant on a month-to-month basis, and Landlord may accept or refuse rent at its discretion. ARTICLE 11: LEAD-BASED PAINT DISCLOSURE If the Property was built before 1978, Tenant acknowledges receipt of the EPA-required pamphlet "Protect Your Family From Lead In Your Home" and any known lead-based paint hazard disclosures for the Property. ARTICLE 12: DEFAULT AND REMEDIES 12.1 Tenant Default. Tenant shall be in default if: (a) Tenant fails to pay rent when due; (b) Tenant materially breaches any term of this Lease; (c) Tenant abandons the Property; or (d) Tenant becomes bankrupt or insolvent. 12.2 Landlord Remedies. Upon Tenant default, Landlord may terminate this Lease and pursue all remedies available under applicable law, including eviction, recovery of unpaid rent, and damages. ARTICLE 13: GENERAL PROVISIONS 13.1 Entire Agreement. This Lease is the entire agreement between the parties and supersedes all prior negotiations and representations. 13.2 Governing Law. This Lease shall be governed by the laws of the State of California. 13.3 Severability. If any provision is unenforceable, the remaining provisions remain in effect. 13.4 Notices. All notices shall be in writing delivered by certified mail, hand delivery, or email with acknowledgment. 13.5 Joint and Several Liability.
